Introduction

During the Sweepstakes Entry Period (defined below) you can receive one entry for a weekly prize. During the Sweepstakes Entry Period, there are 34 weekly prize drawings. Non-winning entries for a weekly prize carry over into subsequent weekly prize drawings. Limit of one weekly prize entry per person for the Sweepstakes. Separately you will also have the opportunity to automatically receive one entry for the grand prize and monthly prize drawings when you sign in to the BBVA Compass Mobile Banking app. Each day during the Sweepstakes Entry Period you can receive one (1) additional entry in the grand prize and monthly prize drawings.

1. Eligibility

Sweepstakes is open to legal residents of the 50 United States (and DC) who are of legal age of majority in their state of residence (and at least eighteen (18) years of age) as of date of entry. Employees of BBVA Compass, and its parent, subsidiaries and affiliates, prize suppliers, and the advertising and promotion agencies of BBVA Compass, and their respective parents, subsidiaries, affiliates, and advertising and promotion agencies are not eligible to participate. Void where prohibited or restricted by law. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. In order to enter the Sweepstakes or receive the prize, you must fully comply with the Official Rules and, by entering, you represent and warrant that you agree to be bound by these Official Rules and the decisions of BBVA Compass, whose decisions shall be binding and final in all respects relating to this Sweepstakes.

3. Timing

The Sweepstakes begins May 14, 2018 at 12:00:00 AM Central Time (“CT”) and ends January 2, 2019 at 11:59:59 PM CT (the “Sweepstakes Entry Period”).

4. How to Enter for Weekly Prize Drawing, Monthly Prize Drawing and Grand Prize Drawing

How to Enter for Weekly Prize Drawing

A.     Enter by Completing BankerDemo: During the Sweepstakes Entry Period, BBVA Compass consumer and small business customers with any account that is eligible to access BankerDemo through the BBVA Compass Mobile Banking Service (“Mobile App”) will receive one (1) entry into the Weekly Drawing when they successfully register through BankerDemo in the Mobile Banking App and complete a demonstration. The demonstration will include signing in to Mobile Banking using the customer’s username and password, activating the BankerDemo (done by the BBVA Compass banker) and completing a mobile demonstration of one or more of the following banking products or services: 1) mobile remote deposit capture; 2) activating account alerts; 3) simple cash back; 4) payments and transfers; 5) activate credit or debit card; 6) mobile banking direct deposit form; 7) view account statement; 8) search for transactions 9) process bill payment or 10) Go Paperless. Details for each demonstration are detailed below. Entrants are limited to only one Weekly Entry for the entire Sweepstakes.

Mobile Remote Deposit Capture Demo: To complete a mobile demonstration of mobile remote deposit capture, a customer must sign in to the BBVA Compass Mobile Banking App, register through BankerDemo with the assistance of a BBVA Compass employee and successfully submit a mobile deposit using this service and then sign out of the mobile app.

Activating Account or Transaction Alerts Demo: In order to complete a mobile demonstration of activating account or transaction alerts, a customer must sign in to the BBVA Compass Mobile Banking App, register through BankerDemo with the assistance of a BBVA Compass employee and successfully activate at least one account alert that is not currently active and save their alert preferences and then sign out of the mobile app.

Simple Cash Back Demo: In order to complete a mobile demonstration of Simple Cash Back, a customer must have an active BBVA Compass consumer credit card or consumer debit card. The customer must sign in to the BBVA Compass Mobile Banking App, register through BankerDemo with the assistance of a BBVA Compass employee and successfully activate at least one Simple Cash Back offer and then sign out of the mobile app.

Payments & Transfers Demo: In order to complete a mobile demonstration of Payments & Transfers, a customer must sign in to the BBVA Compass Mobile Banking App, register through BankerDemo with the assistance of a BBVA Compass employee and either successfully transfer money between two accounts, process a payment, send a wire or an ACH using BBVA Compass’ Payments & Transfers option in the BBVA Compass Mobile Banking App. In order to complete a Payment & Transfer the customer may be required to receive a one-time security code via SMS text and then enter the one-time security code in the app. Once completed the customer will tap the “Submit” button, receive an on-screen confirmation message and then sign out of the mobile app.

Activate Credit or Debit Card Demo: In order to complete a mobile demonstration of Activate Credit or Debit Card, a customer must have a BBVA Compass credit card or debit card that is pending activation. The customer must sign in to the BBVA Compass Mobile Banking App, register through BankerDemo with the assistance of a BBVA Compass employee and successfully activate the card. In order to complete the activation process, the customer will be required to receive a one-time security code via SMS text and then enter the one-time security code and the CVV code from the back of the card. Once completed the customer will receive an on-screen confirmation message and the card status will appear as “Active”. The customer will then sign out of the mobile app.

Mobile Banking Direct Deposit Form Demo: In order to complete a mobile demonstration of the mobile banking Direct Deposit Form, a customer must sign in to the BBVA Compass Mobile Banking App, register through BankerDemo with the assistance of a BBVA Compass employee, use the Search function to search for “Direct Deposit” or navigate to the Manage Account screen for a checking account and tap on Direct Deposit Form. The client will then tap on “Send or Print Form”. The information in this form is sensitive in nature. It is not necessary for the customer to actually send or print the information in order to receive an entry in the sweepstakes. At this point, the customer may cancel the process and then sign out of the mobile app.

View Account Statement Demo: In order to complete a mobile demonstration of View Account Statement, a customer must sign in to the BBVA Compass Mobile Banking App, register through BankerDemo with the assistance of a BBVA Compass employee and successfully view an account statement by tapping on “View Account Statements” and selecting a statement from the options listed. Once completed the customer will then sign out of the mobile app.

Search for Transactions Demo: In order to complete a mobile demonstration of Search for Transactions, a customer must sign in to the BBVA Compass Mobile Banking App and register through BankerDemo with the assistance of a BBVA Compass employee. Once in the app, a customer must select a checking account with transactions and then tap the “I want to menu” and select “Search for Transactions”. Next customize the filters and “Apply Filters”. Once completed the customer will then sign out of the mobile app.

Process Bill Payment Demo: In order to complete a mobile demonstration of processing a Bill Pay, a customer must sign in to the BBVA Compass Mobile Banking App and register through BankerDemo with the assistance of a BBVA Compass employee. Once in the app, select “Bill Pay” from the main menu. Next, the customer will be prompted to select the account they will be paying from, designate the recipient, amount and pay date. Finally, the customer will select “Submit” and receive an on-screen confirmation. Once completed the customer will then sign out of the mobile app.

Go Paperless Demo:  In order to complete a mobile demonstration of Go Paperless, a customer must sign in to the BBVA Compass Mobile Banking App and register through BankerDemo with the assistance of a BBVA Compass employee. Once in the app, select “Settings” from the main menu. Next, the customer selects “Go Paperless”.   Finally, the customer will toggle the radio button on the right side of the screen and tap “Submit” and receive an on-screen confirmation. Once completed the customer will then sign out of the mobile app.

Mobile Banking App Limitations: Mobile demonstrations must comply with the BBVA Compass Mobile Banking Terms of Use. Not all attempts to perform mobile banking demonstrations through BankerDemo are guaranteed to be successfully processed. All deposits, mobile banking services and accounts are also subject to the respective Account Agreement. Accounts must be in good standing according to the Terms and Agreements associated with the respective account. Should joint owners or multiple users of the same BBVA Compass account enter the Sweepstakes and a dispute thereafter arise regarding the identity of the entrant, the first person identified as the owner of the BBVA Compass account at the time of entry will be considered the entrant. “Owner” is defined as the natural person(s) who are identified as the owner(s)/signer(s) on the Consumer Signature Card and is defined as the legal entity corresponding to the Primary Taxpayer ID on the Non-Consumer Signature Card.

Mobile Deposit: The BBVA Compass Mobile Banking Service does not accept all types of negotiable instruments (e.g. checks), including, but not limited to, the checks defined as Ineligible Items in the Mobile Deposit Section in the BBVA Compass Mobile Banking Terms of Use. Not all attempts to deposit a check are guaranteed to be successfully processed and all mobile deposits are subject to the per check and consecutive calendar day deposit limits. Entries made with negotiable instruments that are stolen, fraudulent, tampered with, or otherwise altered are not eligible for automatic entry and all such entries will be void. Any deposit with a “chargeback item” (as such term is defined in the applicable Deposit Account Agreement) which is selected as a Potential Weekly Winner (as such term is defined below) shall be disqualified. All deposits and accounts are also subject to either the Consumer Deposit Account Agreement or the Non-Consumer Deposit Account Agreement. Mobile Deposit is subject to eligibility. Deposits are subject to verification and not available for immediate withdrawal. See Terms of Use for details.

B.     Enter by Mailing In: During the Sweepstakes Entry Period hand-print your full name, address, city, state, zip, day and evening phone numbers (area codes included), email address, date of birth, and the words “BBVA Compass Sign In & Win Sweepstakes WEEKLY DRAWING” on a 3” x 5” index card and mail in an envelope with proper postage affixed to: BBVA Compass Sign In & Win Sweepstakes WEEKLY DRAWING, 2200 Post Oak Boulevard, 18th Floor, Houston, Texas 77056. Once received and validated, mail-in requests will be entered into a drawing for a weekly prize. You will also receive one (1) entry into the drawing for the grand prize and monthly prizes. Limit one (1) entry request per postmarked outer envelope. No more than one entry will be allowed per person. No mechanical reproductions permitted. Entries become the property of Compass Bank and will not be returned.

 

How to Enter for Grand Prize and Monthly Prize Drawings

A.     Enter by Signing in for BBVA Compass Digital Service: Individuals will automatically receive one (1) Grand Prize entry and one (1) Monthly Prize entry each time the individual uses their username and password to sign-in to the BBVA Compass Mobile Banking app during the Sweepstakes Entry Period. Individuals can receive a maximum of one entry per day during the Sweepstakes Entry Period in the Grand Prize drawing and the Monthly Prize drawing.

B.     Enter by Mailing In: During the Sweepstakes Entry Period, hand-print your full name, address, city, state, zip, day and evening phone numbers (area codes included), email address, date of birth, and the words “BBVA Compass Sign In & Win Sweepstakes GRAND PRIZE/MONTHLY PRIZES DRAWING” on a 3” x 5” index card and mail in an envelope with proper postage affixed to: BBVA Compass Sign In & Win Sweepstakes GRAND PRIZE/MONTHLY PRIZES DRAWING, 2200 Post Oak Boulevard, 18th Floor, Houston, Texas 77056. Once received and validated, mail-in requests will be entered into the Grand Prize and Monthly Prize Drawings. Limit one (1) entry request per postmarked outer envelope. No more than one entry will be allowed per person per day during the Sweepstakes Entry Period. No mechanical reproductions permitted. Entries become the property of Compass Bank and will not be returned.

Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will be void and your entries and you will be disqualified. Use of any automated system to enter is prohibited and will result in disqualification. BBVA Compass is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected entries all of which will be ineligible to win a prize. 

5. Winner Determination

Grand Prize

On or about January 14, 2019, Sponsor will randomly draw one (1) entry from among all eligible entries received during the Sweepstakes Entry Period. Potential winner will be eligible to win the applicable Grand Prize subject to verification of eligibility and compliance with these Official Rules.

Monthly Prize

On or about June 1, 2018, July 1, 2018, August 1, 2018, September 1, 2018, October 1, 2018 ,November 1, 2018 and December 1, 2018 and January 2, 2019 Sponsor will randomly draw one (1) entry from among all eligible entries received up to the time of the drawing. Non-winning Monthly Drawing entries carry over into subsequent Monthly Drawings. Potential winners will be eligible to win the applicable Monthly Prize subject to verification of eligibility and compliance with these Official Rules. Limit of one (1) Monthly Prize per person for the Sweepstakes.

Weekly Prize

On each Weekly Drawing date, Sponsor will randomly draw one (1) entry from among all eligible entries received. Non-winning Weekly Drawing entries carry over into subsequent Weekly Drawings. Potential winners will be eligible to win the applicable Weekly Prize subject to verification of eligibility and compliance with these Official Rules. Within the Sweepstakes Entry Period there are thirty-four (34)  Weekly Drawings. Each Weekly Drawing will occur on the first business day that the bank is open of each week that includes entries from the prior week. Limit of one (1) Weekly Prize per person for the Sweepstakes.

6. Winner Notification

Decisions of Sponsor, as to verification and all Offer-related activities are final and binding in all respects. The potential winners of all prizes will be contacted by the Sponsor using email or registered mail using the address associated with the customer’s information on file within 15 business days of the Drawing Date. Potential winners must then: (a) verify his/her identity, eligibility and compliance with these Terms and Conditions as specified by Sponsor in its sole discretion; and (b) provide his/her mailing address and email address. Potential winners will also be required to sign and return an Affidavit of Eligibility, a Liability Release, Federal and State tax releases, and where lawful, a Publicity Release via overnight mail within seven (7) days of attempted notification. If documents are not returned on a timely basis, or if offer notification is returned as non-deliverable, or if you are found to be ineligible or not in compliance with these Terms and Conditions, a prize may be forfeited and not awarded. Once Sponsor verifies claim for said prize you will be asked to visit a BBVA Compass branch to participate in a publicity photo and/or video session and interview, unless prohibited by law. The photograph, video and/or interview will be used to develop marketing and publicity materials. Upon completing these requirements, the prize will be deposited in your account within 2-3 weeks. Grand Sweepstakes Winner and/or monthly prize winner will be issued an IRS Form 1099 for tax purposes for the retail value of the redemption bonus and are advised to seek independent counsel on the implications of same.

7. Prizes

  • One (1) grand prize will be awarded. Grand prize winner will receive ten thousand dollars ($10,000). Approximate Retail Value (“ARV”) of grand prize is $10,000.
  • Eight (8) monthly prizes will be awarded. Each monthly prize winner will receive one thousand dollars ($1,000). Total ARV of all monthly prizes is $8,000.
  • Thirty-four (34) weekly prizes will be awarded. Each weekly prize winner will receive five hundred dollars ($500). ARV of each weekly prize is $500. Total ARV of all weekly prizes is $17,000.

For all prizes: The prize amount may be deposited to the winner’s eligible deposit account. In the Sponsor’s sole discretion, or if a winner enters by mail or does not have an account with BBVA Compass at the time of award, the prize will be awarded as a check payable to the winner. Prizes are not transferable. No substitution permitted except at the sole discretion of Sponsor, who reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value. All federal, state, and local taxes and any other costs and expenses associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the winner. Total ARV of all prizes is $35,000.

8. Entry Conditions and Release

Each entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of Sponsor, which are binding and final in all matters relating to this Sweepstakes; (b) defend, indemnify, release and hold harmless the Sponsor, and its respective parent, subsidiary, and affiliated companies, celebrities, and any other person and organization responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Sweepstakes, acceptance, possession, attendance at, defect in, delivery of, inability to use, use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry. Winners acknowledge that all prizes are awarded as-is without warranty of any kind.

9. Publicity

Except where prohibited or restricted by law, winner’s acceptance of prize constitutes the winner’s agreement and consent for Sponsor and any of its designees to use and/or publish winner’s full name, city and state of residence, photographs or other likenesses, pictures, portraits, video, voice, testimonials, biographical information (in whole or in part), and/or statements made by winner regarding the Sweepstakes or Sponsor, worldwide and in perpetuity for any and all purposes, including, but not limited to, advertising, trade and/or promotion on behalf of Sponsor, in any and all forms of media, now known or hereafter devised, including, but not limited to, print, TV, radio, electronic, cable, or World Wide Web, without further limitation, restriction, compensation, notice, review, or approval.

10. General Conditions

Sponsor and its subsidiaries, affiliates, divisions, partners, representatives, agents, successors, assigns, employees, officers and directors shall not have any obligation or responsibility, including any responsibility to award any prize to entrants, with regard to: (a) entries that contain inaccurate information or do not comply with or violate the Official Rules; (b) entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (c) entrants who have committed fraud or deception in entering or participating in the Sweepstakes or claiming the prize; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any inability of the winner to accept the prize for any reason; (f) if a prize cannot be awarded due to delays or interruptions due to Acts of God, natural disasters, terrorism, weather or any other similar event beyond Sponsor’s reasonable control; or (g) any damages, injuries or losses of any kind caused by any prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any prize or resulting from participating in this Sweepstakes or any promotion or prize related activities. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be (a) tampering with the entry process or the operation of the Sweepstakes; (b) acting in violation of the Official Rules; or (c) entering or attempting to enter the Sweepstakes multiple times through the use of multiple identities addresses or the use of any robotic or automated devices to submit entries. If Sponsor determines, in its sole discretion, that technical difficulties or unforeseen events compromise the integrity or viability of the Sweepstakes, Sponsor reserves the right to void the entries at issue, and/or terminate the relevant portion of the Sweepstakes, including the entire Sweepstakes, and/or modify the Sweepstakes and/or award the prize from all eligible entries received as of the termination date.

11. Limitations of Liability

The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Sweepstakes; (d) technical or human error in the administration of the Sweepstakes or the processing of registrations; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant’s registration is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes. No more than the stated number of each prize will be awarded.

12. Disputes

Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (b) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate Alabama State Court located in Birmingham, Alabama; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (d) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Alabama, without giving effect to any choice of law or conflict of law rules (whether of the State of Alabama or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Alabama.

13. Entrant’s Personal Information

Information collected from entrants is subject to the Sponsor’s Privacy Policy, which is available at https://www.bbvacompass.com/policy/privacy-policy.html.

14. Sweepstakes Results

For the names of the winners, mail a self-addressed, stamped envelope to: BBVA Compass Sign-in & Win Sweepstakes/WL, 2200 Post Oak Boulevard, 18th Floor, Houston, Texas 77056. Requests must be received no later than February 15, 2019.
