What do you mean by "Standard Overdraft Practices"?

We may, at our discretion, authorize and pay overdrafts for the following types of transactions: (i) checks and other transactions made using your checking account number and (ii)automatic bill payments.

We do not authorize and pay overdrafts for the following types of transactions unless you ask us to: (i) ATM transactions; and (ii) everyday debit card transactions. If we do not authorize and pay an overdraft, your transaction will be declined.

We pay overdrafts at our discretion, which means we do not promise that we will always authorize and pay any type of overdraft transaction.

What are Overdrafts?

An overdraft occurs when you do not have enough money in your account to cover a transaction, but the transaction is paid anyway. We may pay items into overdraft under several different circumstances:

    • We have standard overdraft practices that may apply to your account.
    • We also offer overdraft protection plans, such as a link to a savings account or an overdraft protection line of credit, which may be less expensive than fees that apply to standard overdraft practices for your account. To learn more, ask us about these alternative arrangements.

    What fees will I be charged if BBVA Compass pays a transaction into overdraft?

    We will charge you an “NSF Charge - Paid Item” fee of $38* ($32 in CA) each time we pay a transaction into overdraft. There is a maximum of six (6) NSF fees that can be charged per calendar day.

    Also, if your account becomes overdrawn and continues with a negative balance for ten (10) consecutive calendar days, an extended overdraft fee of $25 will be charged.  An additional $25 extended overdraft fee will be charged if the account remains negative for twenty (20) consecutive calendar days.

    Once I make a decision, can I change my opt-in/opt-out choice?

    Yes, you may change your choice at any time by phone, by mail, through BBVA Compass Online Banking or at a BBVA Compass branch. It is your choice.

    I already have Savings Sweep Overdraft Protection tied to my savings account. Do I still need to opt-in?

    Electronic transactions are authorized based on the available balance of your checking account at the time you make your purchase, not the available balance in your savings account.

    If you have not opted-in, your everyday debit card transaction could be denied if your checking account available balance is insufficient to cover your purchase.

    What if I have more than one account?

    If you choose to opt-in, you must do so for each account – it is up to you to decide how you wish to have potential overdrafts handled for each account you have.

    How does my choice affect my Overdraft Protection Line of Credit that I have with my checking account?

    Regardless of the choice you make, your Overdraft Protection Line of Credit should continue to work the same as it does today. However, if you should exceed your line of credit limit and you have “opted-in”, we may choose to authorize and pay the item. You will be charged an overdraft fee (NSF Charge-Paid Item) if we pay an item into overdraft, and extended overdraft fees also could apply. If you “opt-out” we will not pay the item into overdraft, and you will not be charged an overdraft fee.

    Why did BBVA Compass make changes to overdraft coverage?

    New federal regulations changed the way we authorize and pay ATM and everyday debit card transactions for consumer checking accounts. The new regulations require us to get your permission before we may authorize and pay an ATM or everyday debit card transaction when there are not enough funds in the account to cover the transaction and before we may charge a fee for doing so.

    These changes became effective July 1, 2010 for new consumer checking accounts and August 15, 2010 for existing consumer checking accounts.

    Is the Courtescy Overdraft Option different from Overdraft Protection Line of Credit or Savings Sweep Overdraft Protection?

    Yes

    With the Overdraft Protection Line of Credit or Savings Sweep Overdraft Protection*:

    • You can request that we link your savings account to your checking account or you can apply for a line of credit that can be linked to your checking account.
    • Available funds in your linked account(s) will be used to pay any transaction on your checking account and help you avoid overdrafts or returned items.

    With the Courtesy Overdraft Option**:

    • It’s your choice.  You can opt-in and authorize BBVA Compass to pay, at our discretion, ATM or everyday debit card transactions into overdraft
    • We will charge you an “NSF Charge-Paid Item” fee of $38 ($32 in CA) each time we pay a transaction into overdraft.  There is a maximum of six (6) NSF fees that may be charged per calendar day.  Extended overdraft fees also could apply.
    • While Courtesy Overdraft Option and our standard overdraft practices may help you avoid the surprise of declined transactions, we encourage you to consider our other overdraft protection plans, as they may be less expensive alternatives to the fees that apply to Courtesy Overdraft Option and our standard overdraft practices.

    If you do not want BBVA Compass to authorize and pay overdrafts arising from checks and other transactions made using your checking account number and from automatic bill payments, please call 1-800-COMPASS or visit BBVA Compass Online Banking. When these items are declined or returned due to insufficient available funds in your account, we will charge you an "NSF Charge-Return Item" fee of $38 ($32 in CA) each time we return an item for insufficient funds.

    *Overdraft Protection Line of Credit is subject to approval, including credit approval.  Certain fees apply.  With an Overdraft Protection Line of Credit, your overdraft coverage will be determined by your credit limit.  Having an Overdraft Protection Line of Credit does not guarantee you against paying NSF fees; your line of credit may not be sufficient to cover all transaction.  See terms and conditions for complete details. 

    For Savings Sweep Overdraft Protection, savings account subject to approval.  Certain fees may apply.  Transfers and withdrawals from savings accounts that are not made in person, including sweep transfers from a savings account, are limited to six per month.  Only three of these withdrawals may be check or debit card point-of-sale transactions.  NOTE: if an electronic transaction requires authorization at the time of the transaction (e.g., point-of-sale, ATM and debit card transactions), the authorization will be based on the available balance of the checking account, not the available balance of the savings account.  Having Savings Sweep Overdraft Protection does not guarantee you against paying NSF fees; the amount of funds available in your savings account may not be sufficient to cover all transactions.   See terms and conditions for complete details.

    ** Your opt-in/out preferences and our standard overdraft practices will determine whether or not we will authorize and pay , at our discretion, a transaction into overdraft. Courtesy Overdraft Option may apply to certain transactions that can create an overdraft in your account, including ATM withdrawals and everyday debit card transactions. Your opt-in/opt-out preferences will determine whether Courtesy Overdraft Option will apply to a transaction. Courtesy Overdraft Option and our standard overdraft practices are NOT  a guaranty that your overdrafts will be paid. BBVA Compass is not obligated to pay any item presented for payment if your account does not contain sufficient available funds.  Transactions may not be processed in the order that they occur. The order in which transactions occur, and the order in which they are received and processed by BBVA Compass can affect the total amount of overdraft and non-sufficient fund fees.

    Should you overdraw your account, you will be charged an “NSF Charge – Paid Item” fee of $38 ($32 in CA). Also, if your account becomes overdrawn and continues with a negative balance for ten (10) consecutive calendar days, an extended overdraft fee of $25 will be charged. An additional $25 extended overdraft fee will charged if the ending daily balance in your account remains negative for twenty (20) consecutive calendar days. The total of the negative balance, including any and all fees and charges, and including all non-sufficient funds/overdraft fees is due and payable immediately, without demand.
